If you are Oakland County residential or commercial property that was foreclosed due to unpaid property taxes and sold by the Oakland County Treasurer’s Office, you may be entitled to surplus proceeds from the sale.

Under Michigan law, former Oakland County property owners can file a claim to recover excess funds—the amount remaining after taxes, fees, interest, and administrative costs have been paid—if available. This page outlines your rights, important deadlines, and how to submit a valid claim.

What Are Surplus Proceeds?

Surplus proceeds are the remaining funds from the sale of a tax-foreclosed property after the county recovers the total amount owed. For more information, review the MCL 211.78t.

Who Can File a Claim?

You may be eligible if:

  • An Oakland County residential or commercial property owner who held a title or equity interest at the time of foreclosure.
  • The property was foreclosed due to unpaid property taxes and sold by the county treasurer.
  • The property sale generated more revenue than what was owed in taxes, fees, interest, and administrative costs.

Note: Oakland County has settled all claims related to the Michigan Supreme Court's retroactive ruling on foreclosed property sales. This means that any claims connected to this ruling have been resolved, and no further claims can be submitted or will be paid.

How to File a Claim

  1. Check Your Eligibility
  2. Submit Your Notarized Notice of Intent Form to the Oakland County Treasurer’s Office, which must be received by July 1.
  3. Read all Notifications from the Oakland County Treasurer’s Office
  4. If the sales proceeds are available, submit your court motion to the Sixth Circuit Court in Oakland County by May 15 for a hearing to determine the claim payment.
