52-2 General Civil Frequently Asked Questions

What is a Summons & Complaint Form?

It is notification that you are being sued.

What must I do after I receive a Summons & Complaint?

You have 21 days after receiving the summons to file an answer with the court and serve a copy on the other party or to take other lawful action (28 days if you were served by mail or you were served outside this state).

What happens if I don't respond within the 21 days?

If you do not answer or take other action within the time allowed, a judgment may be entered against you for the relief demanded in the complaint.

What if I don't dispute the claim against me?

If you don't dispute the claim, you could possibly work with the plaintiff's attorney to enter a Consent Judgment.  A Consent Judgment is one that is agreeable to both parties.

A Consent Judgment is not possible, what happens next?

If a Consent Judgment is not possible, an answer should be filed at the court and a pretrial conference will be scheduled.
