Out-of-State Subpoena

The following is the process for filing an Out-of-State Subpoena to be issued by the Oakland County Clerk's Office pursuant to MCL 600.2201 et seq of the Uniform Interstate Depositions and Discovery Act.

Documents must be electronically filed using Tyler Technologies via Odyssey File & Serve. View training and additional eFiling information though the Oakland County eFiling page.

  1. Go to www.oakgov.com/clerkrod/efiling.
  2. Click on 'Launch Efile & Serve Now' to register as a user through Tyler Technologies via Odyssey File & Serve.
  3. Log into the eFiling application and select 'case list' tab. Enter and use case number 2017-111111-XX to file the subpoena form and any additional attachments.
  4. Click on the 'eFile' link.
  5. Use Michigan Subpoena form CC 11a and attach a copy of the out-of-state (foreign) subpoena issued by the appropriate person/court or the order for subpoena from the out-of-state court.
  6. Under the 'Document type' select 'Misc. Docs-No Fee'. There are no court filing fees for this process. However, eFiling charges will apply.
  7. Fill in the required fields and hit 'Submit'. Once the clerk issues and accepts the documents for filing, a copy may be obtained through the eFile Queue. 

Process for further enforcement proceedings:

A motion for a protective order or an order to enforce, quash, or modify a subpoena may be filed after an out-of-state subpoena has been issued by our court, pursuant to MCL 600.2206.

  1. Go to www.oakgov.com/clerkrod/efiling.
  2. Click on 'Launch Efile & Serve Now' to register as a user through Tyler Technologies via Odyssey File & Serve.
  3. Log into the eFiling application and select 'case initiation'.
  4. Under 'Document Type' select 'Misc. Docs-$0'. Note: There is a $20.00 motion fee required. However, the document will need to be submitted without court fees through the eFiling application. Once the eFiling staff reviews the document they will contact the filer to confirm the addition of the $20.00 motion fee -OR- the filer may give permission to add the $20.00 motion fee by adding a comment in the 'Comments' field.
  5. Fill in the required fields and hit 'Submit'. Once the clerk starts the new action and accepts for filing, a copy may be obtained through the eFile Queue.
