“Local Gems” Sweepstake 2022
Official Rules



Oakland County Economic Development (“ED”) is sponsoring a Sweepstake for Participants to support small businesses in Oakland County (“Sweepstake”).  This Sweepstake is governed by these Official Rules (“Official Rules”).  The first prize winner receives $1,000, and the second-place winner receives $500.  The prize money is provided by Genisys Credit Union.  Winners are determined by a random drawing.  Each original selfie photo of an Oakland County small business along with an online entry form received counts as a submission.  Entry forms must be received by 11:59 PM ET, November 26, 2022.  All interpretations of the Official Rules and decisions relating to the Sweepstake made by ED are final.


The Sweepstake begins 12:01 AM ET, November 1, 2022, to 11:59 PM ET, November 26, 2022.  If a Participant cannot submit an entry form online, they can hand-deliver entry(ies) by 4:30 PM ET, November 23, 2022, to the Oakland County Executive Office Building, 2100 Pontiac Lake Road, Building 41 West, Waterford, MI 48328, 1st floor security desk.


This Sweepstake is open to anyone.  The Participant must complete all required sections of the entry form.  The photo must be of a small business in Oakland County.  No purchase is necessary.  Participants must be 18 years or older at the time of entry deadlines.  Void where prohibited--Oakland County Employees and Subcontractors are not eligible to enter or win the Sweepstake.  A small business is defined for this program as an independently owned and operated, legal, brick and mortar business in Oakland County.  Multiple entries, featuring a different Oakland County small business each time, can be submitted by a Participant.  The odds of winning depend on the number of completed entries.


Participants (1) agree to be bound by these Official Rules and by the interpretations of these Official Rules by ED and by the decisions of ED and (2) agree to comply with all applicable federal, state and local laws, rules and regulations, and the Official Rules. By participating in this Sweepstake, Participants also agree to indemnify, hold harmless, and release ED, and any entity involved in the creation, operation, or fulfillment of the Sweepstake and their respective agents, employees, elected officials, officers, directors, successors and assigns from and against all claims, injuries, or damages arising out of or relating to participation in the Sweepstake; the use, misuse, or redemption of the prizes; and for any claim, including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.


Participant must complete and submit all required sections of the entry form (online or hardcopy).  Required sections include providing their first and last name; city they live in; email address; primary phone number; a selfie photo; and name and location of small business in Oakland County.  Participant agrees to Sweepstake Official Rules and allows Oakland County to use first and last name, and photos in promotions.  Participant has consent of all people represented in photo before entry form is submitted.  Online entries must be received by 11:59 PM ET, November 26, 2022.  Hand delivered entries must be received by 4:30 PM ET, November 23, 2022, at Oakland County Executive Office Building, 2100 Pontiac Lake Road, Building 41 West, Waterford, MI 48328, first floor security desk.


There are two prizes.  First prize is $1,000.  Second prize is $500.  Winners are chosen randomly from entry forms.  All applicable taxes, and any other costs and expenses associated with acceptance and use of prizes not specifically provided for in these Official Rules, are solely the Winners’ responsibility.


The Winners will be selected from all eligible entries by December 2, 2022.  The Winners will be notified by December 5, 2022, via phone number on entry form.  If the Winners do not reply by 5:00 PM on December 8, 2022, they will forfeit their prize.  At least two attempts will be made to contact the Winners.  ED reserves the right to select an alternative Winner if any potential Winner fails to comply with these Official Rules.


Prizes will be awarded during a check presentation on December 15, 2022, at a designated location, with Winners using their best efforts to attend the check presentation.  Winners may waive their right to receive prizes.  Prizes are non-assignable and nontransferable.  No substitutions allowed by Winners.  Prizes are not redeemable for cash.  Submission of an entry grants ED the right, except where prohibited by law, to use the Participant’s name, likeness, picture, address (city and state only), voice, biographical information and written or oral statements, for promotional purposes in marketing or publicizing ED and its products or services, without compensation unless required by law.


The potential Winners must prove eligibility, including, without limitation, proof of age, residence and identity, which may include submitting a copy of a birth certificate, driver’s license, passport or similar government issued identification no later than December 14. In the event of non-compliance by a potential Winner, such potential Winner, shall be disqualified and all privileges otherwise due as the Winner shall be terminated and an alternative potential Winner may, in ED’s sole discretion, be chosen from among all of the remaining eligible entries received. To be eligible to be declared a Winner and to receive a prize, the potential Winner(s) must sign, within five (5) days of receipt, an Affidavit of Eligibility and Release releasing Oakland County from any and all liability, loss, claims, demands, and causes of action relating to participating in this Sweepstake; and granting ED the right to use potential Winner’s name, picture and/or likeness, or biographical information for publicity purposes, in any media now or hereafter known, throughout the world in perpetuity without additional compensation or consideration or notification.  ED expressly reserves the right to delay the announcement of the Winners for any reason ED deems necessary.


ED is not responsible if Sweepstake cannot take place, or if any prize cannot be awarded due to events outside of the reasonable control of ED. ED reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstake or any part of the Sweepstake.  Any violation of these official rules by a Winner will result in such Winner’s disqualification as a Winner of the Sweepstake and all privileges as a Winner will be immediately terminated.  There is no limit to the number of completed entry forms dated 11:59 PM ET, November 26, 2022, submitted by Participants.  All information submitted by Participants is subject to and will be treated in accordance with Oakland County’s Terms of Use and Privacy Policies.  All information provided by Participants may be subject to disclosure under the Michigan Freedom of Information Act, court order, or other rule of law.  By submitting an entry in this Sweepstake, Participant represents that (1) he or she has the right to submit the entry; (2) all persons whose name or likeness appear in the entry have unconditionally consented, in writing, to allow their name or likeness in the entry, a copy of such writing will be furnished to ED upon request; (3) the entry does not infringe upon any third party’s proprietary or other rights.
