How do I file criminal charges?

Do not send your information directly to the Prosecutor's Office. We are not an investigative agency and are unable to investigate crimes. If you think you are a victim of a crime you must report the incident directly to a police agency where the crime occurred.

For instance, if the crime took place in the city of Pontiac you would call the Pontiac Police Department.

If your area is covered by the Sheriff's Department you would call the local sub-station. If, however, the incident involved several jurisdictions you may want to contact the Michigan State Police as they could pursue the matter throughout all the county jurisdictions.

My kid was just arrested, do I need to get a lawyer?

That is not advice we can give. If you or someone you know is facing criminal charges it is likely that this office will be prosecuting those charges.

Because we would be on the other side of the issue it would be inappropriate for this office to give any sort of legal advice. If you aren't sure what to do, or how to find an attorney, you can contact the Oakland County Bar Association, Lawyer Referral Service, at 248-338-2100, and they may be able to help.

The Yellow Pages of the phone book is another good resource for locating attorneys in your geographic area.

How do I collect a bad check?

Among the many innovative programs instituted by Prosecutor Gorcyca is the Bad Check Restitution Program. If a merchant's personal attempts to collect on the check are unsuccessful they can file a complaint with the Bad Check Restitution Program. A private company then takes steps to collect on the check. Upon recovery, 100 percent of the face value of the check is returned to the victim. If the maker of the check successfully completes the counseling program no criminal prosecution takes place. This unique program creates a win-win situation, where merchants receive the full value of the check and the criminal justice system is not clogged with unnecessary check complaints. If the maker of the check does not successfully complete the program the merchant is then entitled to file a criminal complaint and pursue charges. For more information call 800-225-7133.

I want to get a Personal Protection Order (PPO), can you help?

Unfortunately we cannot. A PPO is something you obtain directly from the Circuit Court Family Division. The County Clerk's Office can assist you in obtaining and filing the proper paperwork. You may contact them at 248-858-0583.
