Crime Victim Compensation

If you have been injured as a result of a crime, or are someone who assisted a victim of a crime, you may be eligible for compensation. This program may also be available to a surviving spouse, parent, child, grandparent, grandchild, brother or sister of a person who dies as a direct result of a crime. The following is a summary of benefits provided through this program:

What kind of financial help is available?

The Crime Victim Services Commission can help with injury-related expenses that a person must legally pay, and with other eligible losses that can be proven by proper documentation.

(A)   For the injured person (or the parent or guardian if the injured person is under 18 years old):

  • Hospital and medical bills of the injured person
  • Loss of earnings of the injured person
  • Rehabilitative and remedial services for the injured person
  • Counseling for the injured person and family members, and replacement services needed because of the person's injury


(B)   For a survivor (the person filing a claim when the injured person dies):

  • Funeral and burial expenses of the person who died
  • Loss of support for the legal dependents of the person who died (if the person was financially supporting the dependents)
  • Grief counseling for the family of the person who died
  • Hospital and medical bills of the person who died (if the survivor must legally pay them)

Property loss and property damage

Pain and suffering

Crime scene clean-up

Relocation costs, living expenses, or the costs of participating in a trial

Loss of earnings and personal expenses of an injured person's family members

Persons hurt in automobile crimes, including drunk driving, must file a claim with their auto insurance company or with the Secretary of State Assigned Claims Plan.

Crime victims compensation in traffic cases is limited to cases where the injured person dies and there is an unpaid balance on the funeral bill after the no-fault automobile insurance has already paid its burial benefit.
