What to do if you're served with a Subpoena.

Preliminary examinations, trials, formal hearings and other hearings require the testimony of witnesses. Witnesses are notified to appear at court by subpoenas.

A subpoena is a court order to appear and must be obeyed unless the witness is excused.

If you receive a subpoena, go to the court on the day and time stated in the notice. Approach the clerk's counter and inform one of the court clerks of your presence. You may then be directed to the assistant prosecutor or the defense attorney (whomever requested your testimony) so that the attorney knows that you have arrived and are ready to testify.

If you have a conflict with the date and time stated on the subpoena, you must notify the court and request to be excused from appearing. As an alternative, you may also contact the attorney who requested your presence and he/she may assist you in obtaining the necessary permission from the court.
