Circuit Court Case Cycle - Post Conviction Procedures
After a defendant has been convicted he/she may make motions (for example, a request for new a trial).
The Prosecutor Office answers these motions and participates in any hearings necessary.
Sometimes a defendant who has been sentenced to probation violates the terms of that probation. The defendant must then appear before the sentencing judge for a hearing and a determination of whether further punishment is required.
The Assistant Prosecutor attends and participates in those hearings as well. All post-conviction hearings are open to the public.
