Case Cycle - Warrants
An Assistant Prosecuting Attorney assigned to the Warrants Division will review the investigation conducted by the law enforcement agency.
The Assistant Prosecuting Attorney will review the police reports, physical evidence and statements of witnesses and determine whether or not there is sufficient legally admissible evidence present sufficient to allow him/her to authorize a warrant for the defendant's arrest.
The Assistant Prosecuting Attorney will do one of the following:
- Authorize the warrant for arrest when he/she has determined that there is sufficient legally admissible evidence;
- Deny the warrant for arrest when he/she has determined there is insufficient legally admissible evidence that would justify a criminal prosecution;
- Order further investigation by the officer in charge of the case so that all possible information and evidence can be evaluated in determining whether a warrant should be authorized.
