Landlord Tenant Proceedings are proceedings to recover possession of premises and/or obtain a money judgment. The action must be filed at the District Court where the premises are located.
If there is a claim for a money judgment on a landlord tenant case, the District Court has jurisdiction up to $25,000.
Corporations must be represented by counsel. Partnerships may not be represented in court by officers, directors, or other employees who are not licensed to practice law in Michigan.
(1) When filing a landlord/tenant suit against one defendant, you must have:
Summons Landlord-Tenant/Land Contract DC104 (file size 84K): 1 carbon pack or 5 copies.
Note: 3 copies must include the "How To Get Legal Help" verbiage that is at the bottom of pages 2 and 3.
Service of Claim: The Court will provide a court officer for service upon request. Only bonded court officers may execute evictions. You are responsible for all service fees incurred. The court officer will bill you directly ($21 plus mileage).
(2) When filing a landlord/tenant suit against two defendants, you must have:
Complaint, Non-payment of Rent, Landlord Tenant DC 102a (file size 44k): 2 carbon packs or 7 copies.
Please list both defendants’ names on each form. Note: 6 copies must include the "How To Get Legal Help" verbiage that is at the bottom of pages 2 and 3.
Lease/Rental Agreement: 5 copies
Two Addressed Envelopes: 1 for each defendant with adequate postage.
Service of Claim: The court will provide a process server for service upon request. Only bonded court officers may execute evictions. You are responsible for all service fees incurred. The court will bill you directly ($21 plus mileage).
