Register of Deeds - To be Eligible for Recording


Documents recorded in the Register of Deeds office must meet the following eligibilty requirements:

1. 

Names must be typewritten, stamped or printed in black ink beneath all written signatures.

2.

Male grantors/mortgagors must state whether married or single in deeds or conveyance.

3. No instrument by which the title to real estate or any interest therein is conveyed, assigned, encumbered  or otherwise disposed of, may be received for record unless the address of each such person shall be printed, typewritten or stamped upon the face of the instrument.
4. Effective January 1, 1964. The name and address of person who drafts any instrument must be shown on instrument. If such name and address is on back of a one-page instrument, a charge for the extra page will be made.

Any instrument purporting to convey or encumber real estate must, if executed in Michigan, be acknowledged by a notary public. Notary must state expiration date of commission.

6.

Warranty Deeds and Land Contracts must have the County Treasurer's certificate of paid taxes.

7.

Death Certificate or proof of death must be recorded and referred to in, or become a part of, any instrument purporting to convey an interest in land by the survivor(s) under a deed to joint tenants of tenants by the entirety.

8. For documents executed after April 1, 1997, per Pubic Act 591 of 1996 (effective 3-31-97), the following must be met:
A.) Instruments must be electronically, mechanically, or hand printed in black ink on white paper of at least 20 pound weight. 
B.) Typed or printed matter of minimum 10 point type or Larger. 
C.) Margin of 2½" at top of first page only and ½" margins on other 3 sides. ½" margin on all sides of each additional page. 
D.) Type of document must be identified on first line of print - only one document will be indexed per recording. 
E.) Page size is minimum 8½ × 11 and maximum 8½ × 14 for documents as well as attachments.
